John France's Will
Pleas held before the honorable George P Torrence Esq president Judge & Alexander Blair, John Morris and Philip Gatch Esquires Associate Judges of the Court of Common pleas at the Court house in Williamsburg for the County of Clermont at the Term of August in the year of our lord One thousand Eight hundred and twenty one and of this State the Nineteenth.
This day the will and Testament of John France late of the County deceased was produced in Court at the same time came Stephen Lindsey and John Lovell two subscribing Witnesses thereto who being duly sworn depose and Say that they signed their names as Witnesses to said will in the presence and at the request of the Testator and in the presence of each other & that they believed the Testator the said John France to be of Sound and disposing mind Memory and Judgment at the time of Signing & pronouncing the same & that the said Testator in their presence signed published and pronounced the same as his last will & Testament Whereupon ordered Said Will be Recorded
Will To Wit
In the name of God amen. I John France considering the uncertainty of this mortal life and being of sound mind and memory, blessed be almighty God for the same, do make & publish this my last will and testament in manner & form following. That is to say. First I give and bequeath unto my beloved wife, Motleanea France all my Estate of every kind during her life time. Then to be devided equiley among my children namely Elisabeth, Michael, Molley, Mary, Evey, & Easter, and as I have devided my former Estate among them & has not devided it equal so at that time I wish them all to be maid equal, whereas my daughter Ester has not had as much as the rest of the garls by the sum of fifty dollars so she is to have fiftey dollars first. Then the purson that taked care of us in our oald age is to receve a reasonable compensation for their Troubles out of the rest of our estate Then as our Sun Michel France as has had more then a Equal Share of my former Estate by the Sum of thirty eight dollars more than any of the garles, the garls is all five of them To have that Sum first. That is the Sum of thirty eight Dollars after Easter has had her fifty dollars. Then the balance of my Estate is to be devided equal among them all alike, and I also appoint my beloved wife Motleanea France & Joel B Hymer Excutrix & Executor of this my last will & testament hereby revoking all former wills by me made. In Witness whereof I have hereunto set my hand and Seal this 29th day of May in the year of our lord, one thousand Eight hundred and twenty one.

Signed, sealed, published & deliver by the above named John France to be his last Will & testament in the presence Of us who have hereunto Subscribed our names as Witnesses in the presence of The testator. Stephen Lindsey Jon Lovell
Whereupon on Motion the Court grant to them letters Testamentary on said Will to Joel B Hymer one of the Executors in said will named on his Entering In to bond in Eighteen hundred dollars with Stephen Lindsey and James Wood his Securitys. Thereupon the said executor with his said security entered into & acknowledged bond in open Court in Eighteen hundred dollars ? ? as the law directs. The Court further order the personally property of said desceased be appraised and signed by Thomas Medaris, William Denham and Samuel B. Hymer under Oath or affirmation. The Said Executor having took the oath required by law in open Court.
