Jacob Behymer’s Will

I Jacob B. hymer of the County of Clermont & State of Ohio, in view of the uncertainty of life and being of sound mind and memory (blessed be Almighty God for the same) do make and publish this my last will and Testament in manner & form as follows. Viz:

First & principally I commit my Soul into the hands of Almighty God who gave it And my body to the earth to be buried in a decent and christian like manner at the discretion of my executor hereinafter named. Having heretofore disposed of my property and given to each of my children that portion which I designed them to have (with the exception hereafter named) for and in consideration of my Son, Daniels obligation to maintain myself and my beloved wife Elizabeth during our natural lives. I hereby give & Bequeath to my Son Daniel B. hymer the lot whereon I now reside containing about two thirds of an acre lying and being Situated on the waters of Nine Mile Creek and being a part of Samuel Edding's Survey No 1366 together with all the improvements thereon. Also all of my personal property of whatever description. Lastly, I hereby appoint my Son Daniel Executor of this my last Will and testament, ratifying and confirming this and none other to be my last will and Testament. In witness whereof I have hereunto set hand and affixed by Seal this 21 Aug 1856.

Probate of the last Will of Jacob B. hymer deceased presented on the 9th day of August A. D. 1862

Personally appeared in open Court William W. Ricker one of the subscribing witnesses of the last Will and Testament of Jacob B. hymer deceased, who being duly sworn according to Law to speak the truth the whole truth and nothing but the truth in relation to the execution of said will deposeth and says that he was present and saw the said B. J. Ricker now deceased sign said will as a witness in the presence of this affiant and at the request of the testator and in his presence, that the said signature of the said deceased witness to said will is genuine, and that they were present at the making of Said Will and at the request of the deceased subscribed their names to said Will as witnesses in the presence of the deceased and of each other, that they saw the said Jacob B. hymer deceased sign and seal said Will and heard him acknowledge the same to be his last will and Testament, that the said Jacob B. hymer was at the time of making signing and Sealing said will of legal age and of sound and disposing mind and memory and under no undue or unlawful restraint whatsoever.
