James Tippett’s Will
In the name of God Amen. I James Tippett of the County of Fauquier and State of Virginia being weak in body, but of sound mind and disposing memory for which I thank God and calling to mind the uncertainty of human life, knowing that is appointed for all men once to die, and being desirous to dispose of all such worldly estate as it hath pleased God to bless me with do make & ordain this as my last will and testament in manner and form following Viz, First I desire that all my just debts and funeral expenses be paid and performed and after this is done, the balance of my estate both real and personal of all and every kind whatsoever that in anywise belongs to me, my will and desire is that my beloved sister Elizabeth Tippett inherit, have and enjoy the same during Her natural life, privileging her to do as She pleases with all and every part and parcel she inherits by me, except as hereafter excepted. My will and desire is that after the death of my loving sister Elizabeth Tippett, that all the lands with their appurtenances belonging to me shall immediately after the death of my sister Elizabeth Tippett revert to and belong to my well beloved friend James Payne, to be and remain his and his heirs forever, the said James Payne paying as a consideration for the same, the following sums of money to my connexions namely, he shall pay to by brother John Tippett or his representatives two hundred dollars, to my sister Mary Coppage or her representatives two hundred dollars and to my two nieces Mary Foxworthy and Elizabeth Foxworthy daughters of my sister Nancy Foxworthy, each one hundred dollars or their representatives and when this is done the land and all the land belonging to me shall be uninterruptedly his and his heirs forever and furthermore all the rest of the property belonging to me and that my sister Elizabeth inherits from me, to wit my negroes, my desk, wheat fan, waggon and every other article she inherits from me or by me she is at full liberty to do as she pleases with it except that she shall let my sister Sarah Campbell have the use or benefit of one negro which said Sarah Campbell lives, and after her decease, my sister Elizabeth Tippett is to dispose of said negro according to her own wishes or liking.
And lastly, I do hereby constitute my well beloved friend James Payne as my executor to this my last will and testament authorizing him to superintend the estate so fallen into the hands of my sister Elizabeth Tippett and that an unnecessary waste be not made of the same, he shall do, and I do hereby revoke all other or former wills or testaments by me heretofore made, ratifying and confirming this as my last.

At a Court held for Fauquier County, on the 25th day of January 1830.
This last will and testament of James Tippett deceased was proved by the oaths of the three subscribing witnessess thereto, and ordered to be recorded. And on the motion of James Payne, the executor therein named, who made oath thereto, and together with Lewis Waller and Richard H Gaines, his securities, entered into and acknowledged a bond in the penalty of two thousand dollars conditioned as the law directs, a certificate is granted him for obtaining probat of said will in due form.
