WILL OF JOHN P'HIMER

John P'Himer’s Will

 

In the name of God Amen I John P'Himer of the State of Kentucky and County of Bath

knowing the uncertainty of life and the certainty of death being  of  sound mind  and

disposing memory do make this my last will and testament.

Item first.  It is my will that my just debts to be paid.

Item second.  It is my will that my three sons Jess, Andrew and James, children of

my first wife receive each one hundred and ten dollars with what they have  heretofore

received.

Item 3rd.  It is my will that my two daughters Sally and Rachel, children of my

first wife have each seventy five dollars with what they have heretofore received.

Item 4th.  It is my will that my present wife Katharine P'Hymer have full possission

of my plantation and all the stock & property etc theron that she may have the means to

raise and educate my youngest children provided she remain my widow.  Should she marry

it is my will that she take so much of my property as the law allows.  Should she not

marry and continue on the farm, it is my will that my three youngest sons John, Asa and

Jefferson stay with their mother until they reach the age of twenty one assist in

taking care of the family stock etc and at the death of my wife it is my will that my

three sons John Asa and Jefferson have the plantation and half of the price of my negro

boy Alfred.  It is my will that the remainder of my property be equally devided with my

five daughters by my last wife.  Given under my hand this 4th day of September in the

year of our Lord 1841.

Addendums

            In addition to my will now desposited with Joseph G. Williams my will and desire is

that Elizabeth Warner daughter of Benjamin Warner if alive one  dollar as witness my

hand and seal this 1st day of December 1843 Attest M——-Gill, David Moore, Saml C.

October 17th 1843 additional item to the within will.  It is my will that any pieces

of property I have advanced to my children by Katharine my second wife be accounted for

by them when a General devision of my estate shall  take place.  I have advanced to

Polly Watters and Caroline Crouch some property for which I have made a memorandum.
