Mary H Behymer’s Will
I Mary H Behymer of Clermont County Ohio, do make and publish this my last Will and testament, hereby revoking all other Wills by me made.
First – It is my will that all my debts, including expense of my last sickness, and the cost of placing a suitable tomb-stone to mark my grave, be first paid out of my estate.
Second – I give and bequeath to my son William T. Whitaker the note I now hold against him dated November 20th 1882 for the sum of Eighty dollars, with 8% interest, and also the sum of fifty dollars, to be paid him by my executor as soon after my decease as practicable.
Third – I give and bequeath to my daughter Susan Ward, the sum of fifty dollars.
Fourth – I give and bequeath to my son James H Whitaker fifty dollars.
Fifth – The rest and residue of my estate I give and bequeath to my daughter Mary A Pompelly, and my grand daughter Mary E Short, share and share alike to be to them and their heirs forever.
I hereby nominate and appoint Frank Davis of New Richmond Ohio as executor of this Will. In testimony whereof I have hereunto set my hand and seal this 15th day of June A. D. 1886.

Probate of the last Will of Mary H Behymer deceased, presented on the 11th day of October A. D. 1887
Personally appeared in open Court, John Lush one of the subscribing witnesses of the last Will and testament of Mary H Behymer deceased, who being duly sworn according to law to speak the truth the whole truth and nothing but the truth in relation to the execution of said Will, deposes and saith that he knew the said Mary H Behymer in her life time that he was present at the making of said Will, and at the request of the deceased, subscribed to said Will as a witness thereto, in the presence of the deceased, and of J. W. Herron the other subscribing witness: that he saw the said Mary H Behymer deceased, sign and seal said Will, and heard him acknowledge the same to be her last Will and Testament: that the said Mary H Behymer was at the time of making, signing and sealing said Will of legal age, and of sound and disposing mind and memory, and under no undue or unlawful restraint whatever, and that said testator is now dead.
