Melcher Waggoner’s Will
I Melcher Waggoner of the County of Franklin and state of Virginia, do hereby make my Last Will and Testament in the manner and form following that is to say
1st It is my desire that after my decease my Executor hereafter named sells such of my perishable property as he may think proper and pay all my just debts and funeral expenses.
2ndly after the payment of my just debts and funeral expenses I give unto my wife Elizabeth Waggoner all the remaining ballance of my estate both real and personal, for and during the term of her natural life, and after her decease
it is my desire that my Executor sell the remaining ballance of my estate lands and the moneys arriving therefrom to be equally divided amongst my several children and my daughter in Law Jane Waggoner to wit: Anna Fishburn, John Waggoner Daniel Waggoner and Jane Waggoner for the support and raising of her several children who she had by her husband Henry Waggoner. 3rd and lastly I do hereby constitute and appoint my son in law Jacob Fishburn Executor of my Last Will and Testament hereby revoking all other or former Wills or testaments by me heretofore made. In witness whereof I have hereunto set my hand and affixed my seal this 23rd day of November 1843.

This last Will and Testament of Melcher Waggoner Dec’d was produced in court and proved by the oaths of James M. Hamilton and Peter Fishburn two of the subscribing witnesses hereto and ordered to be recorded. And the Executor in said will named having departed this life, and the widow of said decedent relinquishing her right to administration On the motion of Samuel Fishburn who made oath and gave bond and security according to law certificate is granted him for obtaining letters of administration with the Will annexed of the said Melcher Waggoner Dec’d in due form
