Samuel Behymer’s Will
In the name of the beloved Father of all I Samuel B Hymer of the County of Clermont and State of Ohio being sick & weak and boddy but of sound and disposing mind and memory considering the certainty of death and the uncertainty of the time thereof and being desirous to settle my worldly affairs and thereby be the better prepaired to leave this world when it may please god to call me hence do hereby publish this my last Will and Testament in manner and form following that is to say
1st I commit my soul into the hands of Almighty God and my boddy to the earth to be decently buried and after the expenses of my last sickness and buriel and debts are paid I devise as follows
2nd I give and bequeath unto my two sons James & Henry all of a certain tract of land known and described as my homestead farm lying and situate in Ohio Township County and State aforesaid bounded on the South by lands of Lewis B Hymer on the East by Wm B hymer on the North by Thomas Matt? And on the West by Samuel B Hymer jr to be equally divided when said Henry attains the age of Twenty one years James having the choice of lots? The above bequest is in consideration of the said Samuel & Henry supporting me & their Mother (Mary B Hymer) during our natural lives.
3rd I give and bequeath unto my two sons Findley and Aaron all of a certain tract of land that I own situate and lying between the lands of John and Samuel B Hymer in the Township and County aforesaid to be equally divided between them when they arrive at the age of Twenty one years there being no timber allowed be cut on said tract during their minority.
4th I bequeath unto my daughter Elizabeth Eppert and Jane Summerfield and my son Aaron the sum of one hundred Dollars each to be paid out of demands each to be paid out of demands owing to me by my sons James & Lewis B Hymer.
5th I bequeath unto my sons William John Lewis Samuel and James and my Daughter Anna the sum of one Dollar each.
6th After the adjustments of all my just debts as mentioned in my first bequest I wish the remaining portion of my personal property kept for the use of the farm so that my minor children may have a support until they arrive at the age of Twenty one years old. I however except all my house furniture which I devise unto my beloved wife.
7th I hereby appoint Samuel and Lewis B Hymer my Executors of this my last Will and Testament In Testimony whereof I have hereunto set my hand and seal this 6th day of September in the year 1848.

Personally appeared in open Court David Kirgan and John Wagner jr of lawful age who being duly sworn according to law deposes and says that they were present and saw Samuel B Hymer sign & read his last Will and Testament that he the said Samuel B Hymer was of sound mind and memory that he was under no restraint that he signed said Will of his own free will and file (sic) asure that he was over twenty one years of age that he acknowledged this to be his last Will & Testament and that he requested us to sign this Will as Witness
