William Behymer’s Will

 

In the name of the Benevolent Father of all I William Behymer aged 72 years of the County of Clermont and State of Ohio do make and publish this my last Will and testament.

 

Item 1st I give and devise to my beloved wife Mary in lieu of her dower and to my daughter Annetta Guild the farm on which we now reside containing about Ninety acres being all the real estate I posses to be held equally and jointly by them during the natural life of my said wife Mary and all the stock household furniture provisions money and chattles that I may be possessed of at the time of my decease (excepting the few items hereinafter mentioned to be held and used by them my said wife Mary and Annetta Guild during the natural life of my said wife.

 

Item 2nd At the death of my said wife the real estate aforesaid I give and devise as follows to wit: To my daughter Annetta Guild and her heirs the house in which we now live and all appertaining there unto and Twenty Five acres of land. The remainder of my real estate about Sixty Five acres I give and bequeath to my sons Oliver Behymer & Freeman Behymer and my daughters Elizabeth Hobbs Evaline and Mary Hancock to be divided between them equally as to value.

 

Item 3rd To my son Oliver Behymer I give and bequeath a note of ? against him of one hundred dollars.

 

Item 4th To my son Freeman Behymer I give and bequeath my young mare plow and harness.

 

Item 5th To my daughter Elizabeth Hobbs I give and bequeath one hundred dollars.

 

Item 6th To my daughter Evaline Nash I give and bequeath one hundred dollars.

 

Item 7th To my daughter Mary Hancock I give and bequeath one hundred dollars.

 

I desire that no appraisement and no sale of my personal property be made and that the Court of Probate direct the omission of the same.

 

Item 8th I do hereby nominate and appoint my wife Mary executrix of this my last will and testament.

 

In testimony hereof I have hereunto set my hand and seal this 21st day of July in the year Eighteen hundred and Seventy Three,

Clermont County Clermont Probate Court

Probate of the last Will of William Behymer deceased presented on the 18th day of July A. D. 1874. Personally appeared in open Court E. S. Ricker one of the subscribing witnesses to the last will and testament of William Behymer deceased who being duly sworn affirmed according to law Also John Wagner the other subscribing witness of the last Will and Testament of William Behymer deceased who being duly sworn according to law to have to speak the truth, the whole truth, and nothing but the truth in relation to the execution of said Will, depose and say that they were present at the making of said Will and at the request of the deceased subscribed their names to said Will as witnesses in the presence of the deceased and of each other; that they saw the said William Behymer deceased sign and seal the same to be his last Will and Testament, that the said William Behymer was at the time of making Signing and sealing said Will of legal age and of sound and disposing mind and memory and under no undue or unlawful restraint whatsoever.
